Adoption law in New York covers a range of situations, and the legal process varies significantly depending on the type of adoption involved. We handle adoptions for individuals and families at all stages.
Domestic infant adoption. These cases involve newborns or young children placed for adoption through private arrangements or agencies. We guide adoptive parents through consent requirements, home studies, and finalization in New York Surrogate’s Court or Family Court. Timing and proper documentation are critical.
Stepparent adoption. When a stepparent wants to legally adopt a spouse’s child, the process requires either the consent of the biological parent or, in some cases, a petition to terminate parental rights. We handle the procedural requirements and court filings from start to finish.
Relative or kinship adoption. Grandparents, aunts, uncles, and other family members sometimes step in to adopt children when parents are unable to care for them. New York adoption law is governed primarily by the New York Domestic Relations Law, Articles 7 and 7-A, along with the Social Services Law where agency placements are involved. Here is what New York law requires, in plain terms.
Consent. Under Domestic Relations Law Section 111, the consent of the birth parents is required in most adoptions. Consent can be irrevocable once signed before a judge or authorized official. If a birth parent’s whereabouts are unknown or they have abandoned the child, the court may dispense with consent under specific statutory grounds.
Home study. In most private-placement adoptions, a home study conducted by an authorized agency is required before finalization. This involves background checks, interviews, and a review of the adoptive family’s home environment.
Waiting period. New York generally requires that a child live in the adoptive home for at least six months before a private-placement adoption is finalized, unless the court waives this requirement for good cause.
Court finalization. Adoptions in New York are finalized in Surrogate’s Court or Family Court, depending on the county and circumstances. The New York Courts adoption resources outline which court handles which type of adoption and what documents are required.

Consent is one of the most legally significant moments in any adoption. In New York, once a birth parent signs a judicial surrender before a judge, it becomes irrevocable immediately. An extrajudicial surrender signed before an agency official has a 45-day revocation window. Getting this right the first time requires careful preparation. A misstep here can unravel an entire adoption proceeding.
In contested adoptions, or those moving through the foster care system, one or both biological parents’ rights may need to be terminated before adoption can proceed. New York courts apply specific grounds under the Social Services Law and Domestic Relations Law, including abandonment, permanent neglect, and severe or repeated abuse. These proceedings can be complex and contentious. The New York State Office of Children and Family Services oversees many of the statutory frameworks that govern these situations.
In many New York adoption proceedings, the court will appoint a guardian ad litem to represent the child’s interests independently. Understanding how to work with that guardian, and what the court expects from the guardian’s report, is part of effectively managing an adoption case.
If a child is being adopted from another state, or an adoptive family lives outside New York, the Interstate Compact on the Placement of Children governs the process. The ICPC as it is administered through New York State involves procedural layers that require coordination between multiple state agencies. Delays are common without proper management.
After finalization, New York law governs access to original birth certificates and the issuance of new ones. The New York State Department of Health handles post-adoption birth record requests. A name change for the adopted child is typically handled as part of the finalization order, but it must be properly requested and documented.
New York allows open adoption agreements, which provide for ongoing contact between the adopted child and birth family members after finalization. These agreements are governed by Domestic Relations Law Section 112-b and are enforceable in certain circumstances. Drafting a clear, legally sound agreement from the start avoids future disputes about what the parties actually agreed to.
