A pre-nuptial agreement is always executed before a couple weds. A post-nuptial agreement is signed any time after the marriage. Couples enter into a post-nuptial for any number of reasons, including- they could not properly execute a pre-nuptial agreement before they married. Other reasons include marital discord, adultery, breach of trust, unforeseen increases in wealth or debt or even one spouse entering into a business arrangement with a third party.
Like a pre-nuptial agreement, post nuptial agreement can address what is a party’s separate property and what is marital property. The agreement could detail how property will be distributed upon divorce or death. The agreement may also address whether maintenance will be paid and, if so, how much and for how long.
